You may have seen the notice last week from the National Restaurant Association that the Overtime Rule has been struck down. A federal judge determined that the DOL exceeded its authority with the FSLA overtime rule which significantly raised the minimum salary required for employees to qualify for OT exemptions. This has been a high priority for our industry and after a rigorous few years, we are very pleased to see this outcome. Our partners at Fisher & Phillips caution making any changes just yet as this may not be the last word on this rule. Todd Frederickson states, “While there is reason for employers to hope for a favorable outcome in the end, we recommend continuing to maintain the status quo for now.”
As Colorado experiences smoke-filled skies from the fires to the north and west, our colleagues in Houston and surrounding areas are wringing out after devastating floods. Our hearts and thoughts go out to those who have been displaced and injured. As is common during emergencies, restaurants have pitched in to feed first responders and to provide support and aid to those that need it. As stated by a joint statement from NRA/TRA, “Restaurants serve – and that’s never more true than when disaster strikes….The enduring message in all of this is that we are a community, pulling together to help in need. And when the call comes, restaurants always answer.” The Texas Restaurant Association has a dedicated Harvey Resources webpage that contains a list of up-to-date resources for business owners as well as restaurant employees in Texas. In addition, the Louisiana Restaurant Association has activated the Hurricane Harvey Hospitality Employee Relief Fund to specifically help impacted hospitality workers.
