NLRB Overturns Ruling On Jointly Employed Workers
There is some news that will come as a relief for businesses that are tied to franchises or use outside contractors to help get work done. The National Labor Relations Board is going back to a more common-sense idea of what it means to be a joint employer. Being considered a joint employer means your business can be held liable if an outside company you've hired breaks labor laws. Though traditionally to be considered a joint employer you'd have to exercise direct control over workers, in 2015 that standard was dramatically changed to say that even if you have indirect or unexercised control over workers you could still be held liable. That opened up all kinds of ways that businesses might be unfairly sued. The National Labor Relations Board overturned a 2015 ruling that potentially made it easier for contractors and workers at franchised businesses to form unions and collectively bargain with big corporations. The National Restaurant Association, which feared the 2015 ruling threatened the franchisee model, hailed the board for its decision. Read this article for more information.
